Los Angeles: Officer assigned to the Valley Bureau Violent Crime Task Force was involved in an officer involved shooting.
On February 27, 2008, motorcycle officer Derek Mousseau, a 12-year veteran of the Department and his partner, were assigned to the Valley Bureau Violent Crime Task Force.
At around 6:50 p.m., the officers saw Julio Eddy Perez commit a traffic violation while driving a 1997 burgundy Saturn in the vicinity of Van Nuys Boulevard and Valerio Street. The officers conducted a traffic stop at Cedros and Valerio Streets when they saw four other males in the car. After a brief conversation with the officers, Perez drove away and a short pursuit took place.
At the corner of Valerio and Kester, the left rear passenger, Byron San Jose got out of the car, holding a black metal object with both hands. San Jose advanced on Officer Mousseau’s partner who was still seated on his motorcycle causing him to accelerate and strike San Jose with the front of his motorcycle. At the same time, Officer Mousseau dropped his motorcycle in the roadway and deployed his service pistol, resulting in an officer involved shooting. During the confrontation with San Jose, suspect Perez drove away. The car was abandoned in the vicinity of Willis and Saticoy and the occupants left on foot. Four of the five occupants are accounted for including the driver, suspect Perez.
San Jose received multiple gunshot wounds and was pronounced dead at the scene by Los Angeles City Fire Department personnel.
No officers were injured. The black metallic object possessed by San Jose, turned out to be a metal microphone stand approximately three feet long with a tripod base.
Force Investigation Division personnel responded to the scene and investigated the use of force and the officer involved shooting.

Seems the Communist Times...oops...LA times has attempted to spread misinformation on the OIS that the suspect wasn't arm. I thought part of Journalism Ethics 101 is that reporters need to check witness statements and re-check again before going to print.

well said Centurion. ilove it when people think that their actions will be protected by the liberal community, and instead they are hit by a motorcycle and shot. Maybe some better values at home would have saved the life of this person, or better yet, hopefully the driver gets charged with the death by tryin to get away from the officers. remember low lifes, the police will defend themselves. here is a perfect example.

FRIEND OF BYRON SAN JOSE .... Perhaps you should have been a better friend and kept your buddy out of gangs and criminal activity! If he was not acting like a savage, and attacking a Police Officer, then he would be alive today! You need to take a long hard look in the mirror, because you and all the other "friends and family members" of Mr. San Jose, are to blame for not correcting this young mans moral compass! Fact your friend Byron and all the occupants of the vehicle knew they were being stopped by the Police, yet CHOOSE to flee! Then Byron CHOOSE to exit the car during the pursuit and attack the Officers! Sounds pretty clear cut to me! Try and beat a Police Officer with a metal pipe, because that is what it was, then you need to be stopped! I believe that this savage would have knocked out the officer, then took his gun and executed him! I am just glad that the Officer is OK!
Maybe FRIEND OF BYRON SAN JOSE, you should get a hold of your other "friends" and get them on the straight and narrow!
I get a kick out of these facilitators that come on here and make a feeble attempt at defending the violent behavior of these criminals! How about using some of that intestinal fortitude in helping your friends, BEFORE, they become criminals?! Take the unpopular position with these goof balls of taking the high road, before your speaking of their lives in the past tense!

Your friends should of taken Chris Rock's advice from his video,"How not to get your a** kick by the Police." One of Chris Rock points is to "Obey the Law."
By the way, yes your nickle, give or take a penny, pays our salaries to serve and protect the communities of the City of Angels, however, we Centurions don't get paid to stand still or run when a suspect runs at us with a blunt object.

You know, this guy was not even involved in gangs. In fact all he wanted to do was make music. Coming from someone who knows the family personally the facts that have been presented are not all what they seem. There were plenty of eye witnesses their that can tell you that this man came out with his hands up (and empty).

First, I have heard the accounts first hand and have also followed that up with reading the accounts of what transpired. The lesson to learn here is this. When you are dealing with the police, do not do anything that comes across as aggressive, threatening or just stupid and you wont get shot. These police officers have to make split second decisions and the entire time also realize that the actions cannot be taken back. This individual exited a vehicle after they had already fled. He also decided to exit with a microphone stand and in a manner that GBH could be implied. Think about yourself in this situation and if you were pulled over. Would you do some of the dumb things that individual "San Jose" did? Would you exit a vehicle holding a weapon or anything that could be construed as a weapon? Would you approach a police officer in a threatening manner with the weapon? Any law abiding citizen knows protocol for avoiding these types of confrontations and the issue here isn't the officer or what he did. The problem was that "San Jose" made a stupid decision and he paid with his life. I praise the officer for his quick action and his ability to place a nice group! Police Officers deserve our support and our respect for what they do. They risk their lives every day and they don't make anything near what that type of job should be paid. Don't make judgments against these guys or any other officer until you have walked in their shoes and dealt with the type of people that they deal with every single day.

Centurion - Do not spread lies. Any witness who wasn't in the car, meaning anybody who witness the crime that isn't a criminal disagrees with your lie. San Jose did in fact exit the vehicle with a microphone stand and did in fact go after the officer while he was seated on his bike. This has been coo berated and the officer who shot and killed San Jose acted in defense of his partner. I love it when people like you want to spew lies about things when everybody already knows the facts. I especially love it when you mention that San Jose exited the vehicle with his EMPTY HANDS HELD HIGH. Come on, there was a pursuit and there is protocol at the end of these pursuits. Your friend San Jose acted on his own and did so in a threatening manner. Again, I praise the officer for making a good decision, saving his partner and for the great shooting that he did while under pressure. It goes with the territory, when you act foolish it could cost you your life. Stay safe and Semper Fi LAPD....
